COVID – 19 UPDATE

Morgans is continually monitoring the situation regarding COVID-19. We take the health and wellbeing of our colleagues and clients seriously and have implemented measures to minimise and prevent the spread of the virus in accordance with the Government and NHS guidance.

We have in place a number of additional measures to ensure that, as best we can, we shall continue to provide an uninterrupted service to our clients. We are able to offer telephone appointments to any clients who do not wish to come into the office and will post or email any paperwork that requires to be signed if necessary.

Our aim is to continue to service all of our clients’ needs and minimise inconvenience. As this is an unprecedented set of circumstances we will continue to monitor the situation. We will update our website and social media or contact our clients directly should we require to make changes to our service. Please do not hesitate to get in touch should you have any concerns.

Meantime we thank you for your co-operation and hope that you and your families remain healthy.

Are you ready for Power of Attorney Day?

Mark the date in your diary. 20th November 2019 is Power of Attorney Day across Scotland. Health and Social Care Scotland has now embarked on a national Power of Attorney campaign. They plan to raise awareness and encourage people from all areas and of all ages to consider a Power of Attorney. The campaign is called “People like you” and 29 of the 31 Scottish Health and Social Care Partnerships are signing up.

My Power of Attorney LogoAccording to the My Power of Attorney website “By ‘Starting the Conversation’ we hope to encourage people to think seriously about whether they need, or need to give someone, the legal powers that Power of Attorney provides. By working with colleagues across the public, private and voluntary sector, we have developed an information pack which will give advice on arranging suitable legal expertise and make the process of finding out about and arranging Power of Attorney as straightforward as possible.” You can read more about the campaign by clicking here.

We’re delighted to be part of this campaign. It explains why making a Power of Attorney is an important thing to do, no matter what age you are. It allows you to appoint someone you trust to deal with things you can’t do for yourself. This is important should you sustain an accident or have an illness that means you can’t deal with those things yourself.

Powers of Attorney are becoming more and more popular

Powers of Attorney have become more and more popular year on year. Some believe they’re like an insurance policy to make sure your affairs are looked after properly. With an ageing population in Scotland, it becomes inevitable that more of us will suffer from some form of dementia. You may have experienced this very sad and damaging illness in an elderly relative. Should such a situation arise in your family and your loved one doesn’t have a Power of Attorney in place, you might need to have a Guardian appointed to manage his or her affairs. That doesn’t come cheap and the appointment can take time, just when time is something you might not have.

Presumed Consent – for your organs – but what about your assets?

A new law, recently passed by the Scottish Parliament means that when someone dies, there will be presumed consent – a presumption that their organs will be available for donation, unless the deceased has registered to opt out of automatic donation. The Act received the Royal Assent on 18th July 2019 and will come into force in Autumn 2020. You can read it in full here.

This is a fundamental change in the law. At present, should someone die, unless they have opted in to donate their organs, the consent of the next of kin is necessary before any organs can be removed for transplant. When the new law comes into force, unless a person registers to opt out from organ donation, there will be an assumption that when a person dies, his or her organs can be donated for transplant. If a person decides to opt out of the donation process, he or she must register that decision and that will mean their organs will not be available for donation.

When we first heard about this new Act, we reflected on how this now mirrors the current Succession (Scotland) Act. In the Succession (Scotland) Act, there is presumed consent that your assets will be divided as decided upon by the state.

How do you opt out of the Succession (Scotland) Act?

Opting out of that Act is fairly straight forward – all you need to do is to make your Will.  Your estate will be divided up in accordance with the law of Succession unless you make your Will. That might not always be what you’d like to happen.

This can be particularly stressful for those you leave behind. In some more extreme cases, the law can seem very cruel. One clear example is if you live with your partner and are not married. Should you die without making your Will, your partner has no automatic entitlement to any part of your estate. In fact, should your partner wish to share in your estate, he or she will need to raise court proceedings and have a judge award him or her a share – and it’s not always certain that that will happen.

So, just like organ donation, the law will automatically apply unless you take action to make your own preferred arrangements.

Please remember, the law doesn’t always work in the way you think it might. When it comes to making sure your loved ones are looked after properly after your death, you must “opt out”. When you make your Will you can leave your assets to those you wish to receive them.

MEET THE TEAM

2018 proved to be a busy and exciting year for Morgans. At the beginning of the year, our Dunfermline offices were transformed following a major refurbishment and we rebranded with a new logo and website. By the end of the year we had been joined by new colleagues from Macbeth Currie and extended our services to Kinross with the refurbishment and rebranding of the former Macbeth Currie office there. We’ve seen growth in all areas of our business and enjoyed some personal successes too including our Managing Partner, Claire Morgan, being elected Dean of the Dunfermline District Society of Solicitors (the third of our current partners to achieve this) then topping it with an appointment to the Board of Directors of the Edinburgh Solicitors Property Centre (ESPC) which she will take up later this year. Our two trainee solicitors, Amina Suhail and Jennifer Caldwell, qualified as solicitors and Kirsten Philp gained her Conveyancing Paralegal qualification. Linda Kettles and Sarah Ferguson obtained the Level 6 Award in Residential Letting & Property Management (Scotland) and Isabel Barclay and Claire Morgan have obtained the Letwell Qualification in Tenancy Management for Residential Property in Scotland through the Chartered Institute of Housing and Landlord Accreditation Scotland. Congratulations and thanks to all our colleagues for their personal achievements and contributions to the success of the firm throughout the year.

Over the next few issues we will focus on different services that we offer and introduce you to some of our new colleagues. In this issue we focus on our Dunfermline Family Law and Litigation Department.

Our Family Law and Litigation Department is located in our modern office suite accessed from our Walmer Drive entrance. Joining us from Macbeth Currie as a Consultant Solicitor, John Bain Photo of John Bain(pictured), brings his many years of experience in all aspects of civil, family and criminal litigation. He works alongside Partners, Brian Tait and Russel McPhate. Something of a “Father of the House” at Dunfermline Sheriff Court, John is undoubtedly one of the most experienced and respected solicitors in the area. The majority of his practice is in the field of family law where he is regularly appointed by the court as a Child Welfare Reporter and curator ad litem in difficult cases of adoption, permanence and child welfare issues. John provides advice on all matters of civil litigation including guardianship. Throughout his career John has maintained an interest in criminal law. An able criminal defence solicitor John is on the Duty Solicitor roll at Dunfermline Sheriff Court. John will be a familiar face to Macbeth Currie clients where he worked for 37 years. We consider ourselves extremely fortunate to have attracted a solicitor of John’s experience and calibre. MacBeth Currie Merge with Morgans

TWO OF THE BEST KNOWN FIRMS IN WEST FIFE AND KINROSS JOIN FORCES

 

1st September saw two of the best known firms in West Fife and Kinross join forces. Macbeth Currie, which can trace its roots in Fife back to 1885 merged with Morgans, which celebrates its 25th Anniversary this year. The merger will see the Dunfermline and Kinross legal, lettings and estate agency business of Macbeth Currie transfer to Morgans. The merged business now practices under the Morgans name. Two of the partners of Macbeth Currie, John Bain in Dunfermline, and Ken Paterson in Kinross, have joined Morgans as Consultants.

The close connection between the two firms is nothing new. Morgans was established in 1993 by Blair Morgan, who, until then, had been a senior partner of Macbeth Currie. He was soon joined by the current senior partner of Morgans, Craig Bennet, who had undertaken his training at Macbeth Currie under the watchful eyes of Blair, John Bain and Ken Paterson. It therefore seemed a natural choice to join forces when some of the partners of Macbeth Currie were looking to pass on the business of the firm to a safe pair of hands when planning their retirements from practice.

The Morgans office at 33 East Port, Dunfermline has become the new home for the Dunfermline business of Macbeth Currie. Isabel Barclay, Letting Manager, and Des Baxter Senior Associate will make the move to our East Port Branch. The Kinross office of Macbeth Currie (62 High Street), which will undergo refurbishment, will be rebranded with the Morgans name. In Kinross the Morgans name may not be as familiar as it is in Dunfermline however, Ken Paterson along with Margaret Scott, Wendy McEwan and Angela Prescott will ensure that it is business as usual and will continue to provide the same high quality service, without interruption, to clients old and new.

Practice Manager of Morgans, Caroline Potter, who is overseeing the rebranding, commented “As part of our continued growth ambitions the firm underwent a rebranding at the start of 2018. This coincided with a major refurbishment of our offices at 33 East Port which included the acquisition of another floor of office space. This has given us the capacity for expansion. Macbeth Currie is a respected and trusted name. The solicitors and staff who have joined us from Macbeth Currie have become part of a firm committed to providing a high quality service focused not on just meeting our clients’ expectations but surpassing them. We plan the transition of all client business to Morgans to be a smooth operation

In summer 2017 Brian Tait, formerly a partner at Drummond Miller LLP, joined the firm as part of the expansion of our litigation and family law services. At the beginning of 2018 we acquired more office space. Our litigation and family law department is now housed in our smart offices accessed from Walmer Drive. Our reception, estate agency and lettings departments have all been refurbished providing more space and a bright, open working environment for our colleagues. Our two trainee solicitors, Jennifer Caldwell and Amina Suhail, both qualified this summer and will remain with us as solicitors in our conveyancing and private client departments respectively. Allan Galbraith has joined us as a trainee solicitor and will commence his training by assisting John Morris in conveyancing. Our new colleagues arriving from Macbeth Currie expand our litigation, private client, conveyancing, lettings and estate agency offerings. John Bain, who is a much respected litigator and family lawyer, will join Brian Tait and Russel McPhate in Dunfermline. Des Baxter, who specialises in residential conveyancing joins our conveyancing team in Dunfermline. Both have brought their current case loads with them. It’s be business as usual for Ken Paterson, who specialises in conveyancing and private client, and his team in Kinross but under the Morgans brand name. It is an exciting time for the firm and I am very much looking forward to working with our new colleagues.

Existing clients of Macbeth Currie and former clients who have their wills and title deeds held by Macbeth Currie can expect to hear individually from Morgans in the coming weeks.
