What is “Confirmation”?
Confirmation is the legal authority granted by the Sheriff Court in Scotland that enables the executor to access and distribute the deceased’s assets.
Do I need a solicitor to deal with an estate?
No. However, where there is a will it is up to the Executors appointed to decide whether they require assistance from a Solicitor.
What if there is no Will?
If there is no Will, the estate is considered intestate. An executor needs to be appointed by the Court and that will require the assistance of a Solicitor. Where Confirmation is required for estates where an Executor has been appointed by the Court, an insurance Bond is required. It is a standard condition of that Bond that a Solicitor will need to be instructed to deal with the entire Administration of the estate.
